1. Introduction

These Terms of Service ("Terms") govern your access to and use of the Achieva Africa platform (the "Platform"), operated by Achieva Africa ("we", "us", or "our"). By creating an account or using the Platform, you agree to be bound by these Terms.

If you do not agree to these Terms, please do not use the Platform.

2. Who We Are

Achieva Africa is an online education talent marketplace that connects teachers and education professionals with schools, educational institutions, and education employers across Africa.

The Platform provides a secure environment for educators to showcase their qualifications, experience, and verified credentials, while enabling employers to discover, evaluate, and engage qualified talent.

Achieva Africa is not an employer, employment agency, or recruitment agency. We do not employ teachers and are not a party to any employment, consulting, freelance, or contractual relationship formed between users through the Platform.

3. Account Eligibility

To register and use the Platform, you must:

• Be at least 18 years of age.
• Provide accurate, current, and complete information during registration.
• Maintain the confidentiality of your login credentials and accept responsibility for all activities conducted through your account.
• Use the Platform only for lawful purposes and in accordance with these Terms and applicable laws in your jurisdiction.

We reserve the right to suspend or terminate any account that violates these Terms or applicable laws.

4. Account Types

The Platform supports Teacher Accounts, School Accounts, Educational Institution Accounts, Employer Accounts, and Administrator Accounts.

You may only maintain one account for each applicable account type. Creating multiple accounts to bypass platform restrictions or enforcement measures may result in suspension or permanent termination.

5. Keys and Payments

Achieva Africa operates a digital credit system known as Keys. Certain premium actions on the Platform require Keys.

• Keys may be purchased using supported payment methods available in your country.
• Prices are displayed in the applicable local currency or another supported currency.
• Keys are non-transferable, non-exchangeable, and have no cash value.
• Keys used for completed actions are generally non-refundable unless otherwise stated.
• Unused Keys remain in your wallet and do not expire while your account remains active and in good standing.

6. Refund Policy

Refund requests relating to unsuccessful transactions or unused Keys will be reviewed on a case-by-case basis.

Keys used for successfully completed actions are generally non-refundable.

7. Acceptable Use

You agree not to misrepresent your identity or qualifications, upload false information, harass users, bypass Platform payment systems, access systems without authorization, use bots or scrapers without permission, or upload malicious software.

Achieva Africa reserves the right to remove content, restrict access, suspend accounts, or permanently terminate users who violate these Terms.

8. Verification

Teachers, schools, and institutions may submit documents for verification.

Verification indicates that Achieva Africa has conducted a reasonable review of submitted documentation. Verification is not a guarantee of competence, integrity, professional conduct, employment suitability, or institutional quality.

Users remain responsible for conducting their own due diligence.

9. Engagements Between Users

Any employment, consultancy, freelance arrangement, or other agreement resulting from introductions made through Achieva Africa exists solely between the participating users.

Achieva Africa is not responsible for employment outcomes, salaries, payments, taxes, contractual obligations, or disputes between users.

10. Intellectual Property

All software, branding, logos, graphics, text, designs, trademarks, databases, and other intellectual property created or owned by Achieva Africa remain our exclusive property.

Users retain ownership of content they upload but grant Achieva Africa a worldwide, non-exclusive, royalty-free licence to host, display, reproduce, and process that content solely for operating and improving the Platform.

11. Privacy

Your use of the Platform is governed by our Privacy Policy. By using Achieva Africa, you consent to our collection, use, storage, and processing of your personal information in accordance with our Privacy Policy and applicable data protection laws.

12. Account Suspension and Termination

You may close your account at any time by contacting info@achievaafrica.com.

Achieva Africa may suspend or terminate your account for breaches of these Terms, fraudulent information, fraudulent payments, abuse of other users, or activities threatening Platform security.

Unused Keys may be forfeited in accordance with our Refund Policy.

13. Disclaimer

The Platform is provided on an 'as is' and 'as available' basis. Achieva Africa does not guarantee uninterrupted availability, error-free operation, or successful recruitment outcomes.

14. Limitation of Liability

To the fullest extent permitted by applicable law, Achieva Africa shall not be liable for lost profits, indirect or consequential damages, disputes between users, user-generated content, or failures of third-party providers.

Our total liability shall not exceed the amount paid by you to Achieva Africa during the twelve (12) months preceding the event giving rise to the claim.

15. Changes to These Terms

We may amend these Terms from time to time. Material changes will be communicated through the Platform, email, or other reasonable means. Continued use of the Platform constitutes acceptance of the updated Terms.

16. Governing Law and Dispute Resolution

These Terms shall be governed by the laws applicable in the jurisdiction where the relevant Achieva Africa entity operates or as otherwise specified for users in a particular country.

Users agree to first attempt good-faith negotiations. Unresolved disputes should proceed to mediation or arbitration before court proceedings, where permitted by law.
